The suspended Clerk of the Kisii County Assembly, James Nyaoga, has been officially removed from office following a decisive vote by the Assembly. The decision was announced by Speaker Philip Nyanumba, who cited Nyaoga’s removal as a consequence of gross misconduct, misbehavior, and violations of Chapter 6 of the Kenyan Constitution, as well as County Assembly regulations.
The motion to remove Nyaoga was tabled by Boochi-Tendere Ward MCA, James Ondari. In a heated session, the motion garnered significant support, passing with a majority of 55 votes in favor and 13 against. Ondari stated that the decision was inevitable, given that the allegations against Nyaoga had been substantiated.
“The clerk had to go,” Ondari said. “The evidence was clear, and the Assembly acted accordingly.”
However, the removal has not been without controversy. Marani MCA, who serves as the Minority Leader, strongly opposed the decision, alleging that Nyaoga’s ouster was premeditated. He claimed that the matter had previously been referred to the court, which ruled that the issue should be resolved through the appropriate Human Resource channels—a directive the Assembly allegedly ignored.
“The clerk could not expect justice when some of those who testified against him were his perceived opponents,” the Minority Leader argued, questioning the fairness of the process.
Nyaoga’s removal marks the second significant ousting in recent times within Kisii County’s political landscape. It follows the earlier dismissal of former Deputy Governor Dr. Robert Monda, indicating a turbulent period for the county’s leadership.
